What happens if my visa is denied?

Our sponsors have a 100% success rate in this area and we’re confident in their success.
However in an unlikely event that a visa is refused, Visa officer provides a reasons, refund and no-refund will be strictly based on these specific reasons.
You can refer to Refund & No Refund Criteria prior to your application.

Is the job assured?

Depending on your experience our partner sponsors will try to find the suitable job available or else you need to find an appropriate job and join our sponsorship programme for assured sponsorship which will continue for the period of 5 years.

What is COS?

When we use the term COS, we're referring to the Restricted Ceritifcate of Sponsorship (RCOS). A Tier 2 UK visa requires a valid certificate of sponsorship from an employer holding a valid sponsorship license. The perspective employer must request this license and, if granted, can offer a COS to a candidate via an online sponsor management system.

What is the Tier 2 general programme?

Under the Tier 2 general visa programme you will be responsible for paying the initial cost of the sponsorship, plus sponsorship arrangement charges and consultancy fees up front. The programme attracts sponsorship & consultancy fees upfront plus a monthly service cost on your payroll.

The process of securing the Tier 2 (General) visa & Time duration

The seven-step process will take around 10-12 weeks should sponsors need to place the advert and 6-8 weeks advert is not required. You can download the process flowchart which is also showing the list of required documents.

DOCUMENTS REQUIRED
  • Current CV
  • Copy of ID page of passport
  • Copy of degree certificate/s
  • NARIC certificate
  • Copy of relevant documentation of dependents if applying with the applicant.
PROCESS
  • Applicant to pay full service charge in advance for us to kick start the process.
  • Unless the applicant’s degree is from the UK, they must send degree certificate to NARIC for confirmation of being taught in English; www.naric.org.uk/visas%20and%20nationality/Service.aspx
  • Our sponsor may need to draft an advertisement to be placed on a relevant IT recruitment website and it would need to be at least 28 days old before the Certificate of Sponsorship (CoS) can be issued. Unless they have an advertisement already in place, in which case they can apply for the CoS immediately
  • Sponsor applies for the CoS by the 5th of every month (see timeline attached)
  • Home Office decide on CoS applications by 11th of each month
  • Sponsor assigns the CoS to the individual on the 12th/13th of each month
  • Sponsor sends the paperwork to the individual to submit the visa application to the British Embassy in India
  • The British Embassy generally take around 2 weeks to process

Who is best fit for Tier 2 General?

The Tier 2 General programme is typically the most suitable option for candidates with a good working experience through which they can find a suitable job in the UK, and your experience will also help our sponsors to find a job quickly for you.

The programme involves risks to a certain level; we strongly suggest you to check ‘Roles, Responsibilities & Risk’ section before applying.

The programme is usually the best option for candidates who have a wealth of experience, are married, and who plan to settle in the UK with their spouse, who will also take up work in the country.

Eligibility Criteria

In order to be considered for the programme, you must be qualified to degree level or higher within the IT industry with an experience of 5 plus years,

The programme is not for Fresher’s, please do not apply if you have just completed your university level education,

Roles & Responsibility

Involvement of Pacific Infotech is limited to achieving RCOS (Certificate of Sponsorship) as per the procedure RCOS will be issued only after the Job assurance,

Candidate is responsible to submit the required documents for the visa process, once the visa is approved and the candidate is eligible to start working in UK, the role of Pacific will become void and the candidate will deal directly with our sponsors to remain in UK.

What if I lose my Job by any reason during my sponsorship?

You or the sponsor must find another job quick and fast; however if you may find it early at your end, then you must pass on the Job details to the sponsors ASAP as you will remain on the payroll of sponsors due to the restricted COS.
However in case candidate or the sponsor may not find the suitable job, please be informed that you cannot expect your sponsors to pay for no employment, you will remain responsible for your employment all the time.

Although the possibility of losing the job is limited to either
1. the underperformance of the candidate or
2. cancellation of the job by the employer itself.

However, the latter one is unlikely though we should consider probabilities so you can make informed decisions.

All about Tier 2 Programme

The Tier 2 program allows the skilled workers to work in UK for a skilled job vacancy, e.g. an IT consultant, a software programmer, a teacher, a 2d/3d animator, nurses etc.

The Job vacancy needs to be on the Tier 2 occupation list you can check the Table 2 in the given link,

Or the Job vacancy should appear in the Tier 2 shortage occupation list

The Tier 2 job applicant must have the job offer and COS (Certificate of Sponsorship) from a UK employer holding a valid Tier 2 Sponsorship license.
The Jobs must be advertised within the (EEA) European economic area before they can be offered to non-immigrants. Unless the Job is in the Tier 2 shortage occupation list. The process is normally called ‘Resident Labor Market Test’

Types of Tier 2 Visa?

1. Tier 2 General, as explained above the category is only for skilled workers having a valid COS with a job offer from an employer in UK,

2. Tier 2 Intra company transfer, companies willing to transfer employees to their branch office in UK, applicant must hold a valid COS.

3. Tier 2 (Minister of Religion), a UK organisation offering a Job for a religious purpose with in a religious community

4. Tier 2 (Sports person), Job or sports persons or coaches, the applicant must be recognized by their local sports authority.

What is Tier 2 Shortage occupation list?
In UK, skilled jobs needs to be advertised within European economic area for a set period before they can be offered to a non-immigrant, however apart from this list UK Govt. compiles another list of shortage occupations in UK & Scotland, and for the shortage occupation list labor market test and advertisement to local residents is not required as well. You can find the list here

Documents required for a Tier 2 Visa?

Your application should include the list of documents

  1. A valid passport
  2. Recent photographs
  3. Funds maintenance in your bank that you are keeping enough funds with you to prove your stay in the UK, e.g., a bank statement unless your sponsor can guarantee the maintenance, (only the A-rated sponsors can guarantee this)
  4. Proof that you can meet the English requirements, a qualification equivalent to a bachelor degree or higher taught in English or English language test,
    Applicants with a degree taught in India will need to have their degree verified by NARIC who will issue a certificate to confirm that the degree has been taught in English.
  5. A clean TB test results with a letter if the applicant is from the country of home office TB test list

English Language requirement for Tier 2 Visa?

Tier 2 visa applicants may be required to pass an English test should they have not completed the degree course taught in English. 
Applicants with a degree taught in India will need to have their degree verified by NARIC who will issue a certificate to confirm that the degree has been taught in English.

Tier 2 Visa (Dependents)

A ‘dependent’ is any of the following

1. Your husband, wife or partner
2. Your child under 18
3. Your child over 18 if they are currently in Uk as a dependent

You must show that your dependents can be supported while they are in the UK, each dependent must have £630 available to them whether they apply with you or separately. The money must be in your bank or your dependents bank for at least 90 days before you or they apply.

  5. Freshers are not allowed to apply.
  6. Applicant is fully responsible for the authenticity of documents.

  8. Tier 2 visa programme involves risks clearly stated in the ‘Roles, Responsibility & Risks’ section of the website, which clearly states the risk of losing the job in the UK as well as the risk of visa denial from home office which you duly acknowledge and understands before signing the agreement.
  9. You will only get assistance & directions from our sponsor partners in sorting out the residence in the UK once you will arrive. Though for your comfortable stay we strongly suggest to sort out a temporary residence at your end before your arrival in the UK.

Q:Is the money refundable in case of visa refusal?

A: Yes. The money is refundable as per the given chart though the refusal is highly unlikely considering the reputation of our ‘A’ rated sponsors in the United Kingdom

Q: Can I bring my family to the UK with me?
A: You can certainly bring your spouse and children to the United Kingdom. Your spouse will be free to work anywhere in the country and will be eligible to their full-take home salary without paying a penny in sponsorship fees.

An extra £2,500 (per dependent) will charged to cover the cost of bringing your family to the country.

Q: Will I have any assistance in finding a place to live once I reach the UK?

A: Yes. Our sponsor partners will be on hand to assist you with arranging a place of residence.

Q: What if I am unable to perform in my job as expected in UK?

A: You are responsible for your performance at all times. If you are unable to perform in your new role, your sponsors have the right to cancel your RCOS at any time. Once RCOS has been cancelled, you can no longer stay in UK and will be required to return back immediately. Pacific Infotech bear no responsibility in this case and no refund will be available to you.

However, you will work on the payroll of sponsors in which they will charge a monthly service cost as well, it is highly unlikely they will cancel the RCOS unless it is extremely necessary.

Q: How much I can earn in UK?

A: The UKBA match jobs and salaries against a criteria listed on the UKBA website to ensure that the level of the position is sufficient to hire a migrant worker. Their salary will be paid in line with what is paid to a resident worker.

Q: Who will assist in sorting a residence once I will reach the UK?

A: You will only get assistance & directions from our sponsor partners in sorting out the residence in the UK once you will arrive. Though for your comfortable stay we strongly suggest to sort out a temporary residence at your end before your arrival in the UK.

Q: Are there any scenarious in which the deposisted funds would not be refunded?

A: Yes. The following are all the criteria under which a candidate would not be eligible for a refund.

  REASON REFUND
1. The candidate instructs our sponsor partners to submit an application outside of the UK immigration rules. £0
2. Applicants fails to submit the supporting documents required for the application which results in the application being inelligible to be submitted or refused by the Home Office. £0
3. Non-disclosures or failure to inform our sponsor partners of the candidate’s actual circumstances (any history of visa refusal, illegal immigration status, overstay, criminal record, etc.). Failure to keep our sponsor partners updated of any changes in circumstances and contact information that may affect the outcome of the application or providing false documents. £0
4. As part of the application decision process, the Home Office has the right to request additional information, phone interview or face to face interview, in accordance with the guidance of the immigration rules or changes to the immigration rules. In these circumstances, the candidate must comply with the Home Office’s requirement (the result of the interview will influence Home Office’s decision directly, and applicants shall be responsible for the outcome). A refund will not be issued if a visa is refused as a result of these interviews. £0
5. After the signing of the service agreement, the candidates, due to personal reasons (such as changing mind about staying in the UK or unable to meet the requirements of the visa application, etc.) withdraw from the services under this agreement; £0
6. The candidate has been refused UK visa in the past, which results in the decision of the refusal of this application. A warning will be given to the candidate that this is likely to mean the new application is refused. £0
7. The candidate is refused on the grounds of his/her background; who have been refused on the grounds of having a criminal conviction or unspent convictions that he/she hasn’t declared. £0
